Terms of sale
PREAMBLE AND DEFINITION
The general conditions of sale govern the contractual relationship between the professional and the consumer. The professional seller has a general obligation to provide information to his consumer customer, in accordance with article L111-1 of the French Consumer Code.
The general conditions of sale include all the pre-contractual information that a professional merchant must provide to his customer. In particular, they set out the website's commercial policy, including payment terms, delivery times, the right of withdrawal and any other useful information. This information clarifies the consumer's consent, and informs him of his rights and obligations.
The General Terms and Conditions of Sale (GTCS) also contain the General Terms and Conditions of Use (GTCU), which set out the general rules governing use of the website.
The present general terms and conditions of sale relate to the general terms and conditions of use of the www.MY1996.fr merchant site, but also to the products sold by MY1996 via the website. The acquisition of a product through the present site implies unreserved acceptance by the buyer of the present conditions of sale, which he acknowledges having read prior to ordering.
In accordance with article L221-11 of the French Consumer Code, these general terms and conditions of sale relating to distance selling are subject to communication terms and conditions. They must be provided by the professional to the consumer in a legible and comprehensible manner, and be made available by any means adapted to the remote communication technique used.
The following articles of the same Code also require the trader to make the general terms and conditions of sale available to his consumer customers so that they can keep them, and they must be accessible before any contract is concluded.
Before using our website, we recommend that you carefully read these terms and conditions, as well as our policy on the use of cookies and data processing. By using our website and by placing an order on it, the consumer customer accepts and consents, in the absence of proof to the contrary, to the general terms and conditions of sale.
If you do not accept all of the Terms and Conditions and the Data Protection Policy, please do not use this website.
Our terms and conditions and policies are subject to change. MY1996 reserves the right to modify these terms and conditions at any time by posting a new version on the site.
In particular, in order to respect and comply with legislative or regulatory provisions in force or in the process of being adopted, to which the company is subject.
It is your responsibility to consult them regularly, as the general terms and conditions of sale are those in force on the date the order is placed.
If you have any questions concerning the general terms and conditions of sale, you can contact us using the means communicated via our website.

Customers are free to modify their shopping baskets up to the point of payment. They may delete an item they have previously added, or change the quantities or sizes selected.
We remind you that until payment has been validated, the items in the basket may be ordered by other customers. We do not have a tool for saving items in the shopping cart.
Once the shopping cart has been completed, the customer can proceed to validate it. It will be necessary to accept the terms and conditions of sale before proceeding to checkout.
Please take the time to read the product descriptions, which we take great care to detail, including materials, cuts and colors.
7.1.2 - ORDER VALIDATION
In the case of a first order on our website, the customer must enter the shipping address to which he wishes to receive his parcel, as well as his telephone number.
If this is not the first order, this information will be pre-filled. It is the customer's responsibility to reread this information carefully to ensure that it is correct.

Once the customer has entered all this information, they must check the contents of their basket before proceeding to checkout.
The customer must then click on "Continue to payment". The customer will be asked to enter the chosen method of payment. The customer may pay by credit card, Paypal or gift card (see article 7.3).
To complete the order, the customer must choose a billing address, which may be the same as the delivery address, but may also be different.
Once the payment information and billing address have been completed, the order will be considered validated. The customer will be redirected to a page summarizing the entire order.
For orders that have chosen delivery to a relay point, the customer must choose the relay point at this point.
The customer will receive an order confirmation e-mail containing your order number, the items to be shipped, the quantity ordered, the delivery address, the shipping method and the relay point information.

The order will be dispatched to the delivery address indicated by the customer once payment for the order has been verified and is effective.
Deliveries are made to the address indicated on the order form, which can only be in the following countries: France, Belgium, Luxembourg, Switzerland, Italy, Germany, Sweden, Portugal, Spain, Netherlands, Austria, Denmark and certain overseas territories.
Once your order has been confirmed, it will take some time to prepare your order before it is ready to be dispatched.
MY1996 has a normal order preparation time of 24 to 48 hours. This time may be extended to 72-96h during collection releases or restocking periods, given the high volume of orders.
We remind you that your orders are prepared from Monday to Friday (excluding public holidays, vacations or annual leave).
Once your order has been dispatched, you will receive a confirmation e-mail. From this point on, delivery times depend directly on the carrier and your geographical location.
Generally, deliveries in France via Colissimo are received between 24 and 72 hours after dispatch. For international deliveries, you'll need to allow at least 72 hours and up to 15 to 21 days after dispatch for certain territories such as the French Overseas Departments and Territories.
Delivery times are given as an indication only; if they exceed thirty days from the date of order, the sales contract may be cancelled and the purchaser reimbursed.
MY1996 may provide the purchaser with a tracking number by e-mail.
The delivery of your order is considered effective from the moment that the tracking of your package indicates that it is considered to have been delivered.
In the case of home delivery, if the customer is absent, he will receive a delivery notice from his letter carrier. This allows the customer to collect the products ordered from the nearest post office, within a period specified by the postal service.
In the case of delivery by Click and Collect or at a relay point, delivery is considered effective once the parcel has been made available at the relay point or in our warehouse. In this case, the right of withdrawal begins when the customer collects the order.
When picking up a Click and Collect order, the customer must present the e-mail indicating that the order has been made available, as well as a valid form of identification. Identity will be verified when the order is handed over to the customer. The customer accepts and agrees to this by choosing the Click and Collect delivery method.
The customer must date and sign a document certifying that the order has been collected.
The customer may ask someone else to collect the order. To do so, the person collecting the order must present the customer's ID, their own ID and the order confirmation e-mail received by the buyer.
7.2.3 - PROBLEMS UPON DELIVERY AND/OR RECEIPT OF THE ORDER
At the time of delivery, the customer is obliged to check the condition of the packaging and the contents of the goods in the presence of the La Poste employee or the delivery person. You are responsible for the package and its contents once it has been handed over to you personally. In the event of damage during transport, you must refuse the parcel and contact our customer service department directly to inform us of the problem and the reason for refusal.
In the event of late delivery or loss of a parcel, due to events beyond our control, the customer must contact MY1996 customer service as soon as possible at the following address: sav@my1996.fr. Customer service will take all necessary steps to minimize the effects of the delay and provide solutions to the customer. MY1996 cannot be held responsible in the event of an error in the delivery address when the order is placed.
In the event of delivery failure by the Post Office or failure to collect the parcel from a relay point, the parcel will be returned to our warehouse. Upon receipt of the parcel, customer service will contact the customer as soon as possible by e-mail or telephone to inform them of the situation. If the customer wishes a refund, this will be made in the form of a credit note.
Any complaint formulated beyond the fifteen (15) days following the reception of the products will be considered inadmissible, the responsibility for MY1996 could not be committed. MY1996 reserves the right to ask the buyer to return the non-conforming or damaged product.
7.3 - TERMS OF PAYMENT
Once the customer has filled in all this information and checked the contents of his basket, he must then click on "continue to payment". He/she must indicate his/her choice of payment method.
MY1996 offers the buyer the option of ordering and paying for products in several stages, with two (2) payment options to choose from:
- Secure payment by PayPal (via the PAYPAL system):
MY1996 accepts payment via PayPal.
Once the customer has selected the products they wish to order in the "basket", modified them if necessary (quantities, references...), checked the delivery address or entered a new one, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier.
The customer must choose the payment method: "Payment by Paypal". In the next step, the customer is asked to check all the information and to confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the PAYPAL secure interface, where they can enter their Paypal account details in complete security.
If the payment is accepted, the order is recorded and the contract is definitively formed. Payment by Paypal account is irrevocable. Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge thereof, and waiver of the right to invoke one's own terms and conditions of purchase. All data supplied and the recorded confirmation shall constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, MY1996 will send confirmation of the order by e-mail.
If the buyer wishes to contact MY1996, he may do so by e-mail at the following address: contact@my1996.fr.
- Secure payment by credit card (via the STRIPE system):
MY1996 accepts payment for orders by several bank cards, namely: Visa, MasterCard, American Express and ApplePay.
In the same way as Paypal, the customer selects the products they wish to order in the "basket", modifies them if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, along with the name of the carrier.
The customer then selects the payment method: "Payment by credit card". The next step is to check all the information, then confirm the order by clicking on the "Confirm my order" button. Finally, the buyer is asked to fill in his or her credit card details directly, i.e. credit card number, expiry date and security code. If the payment is accepted, the order is registered and the contract definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the purchaser may demand cancellation of the card payment, in which case the sums paid will be credited back or refunded.
The cardholder is not liable if the disputed payment has been proven fraudulent, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must contest the debit in writing to his or her bank within seventy (70) days of the transaction, or one hundred and twenty (120) days if the contract binding him or her to the bank so provides. The amounts debited will be reimbursed by the bank within one (1) month of receipt of the cardholder's written objection. The cardholder will not be charged any fees for the return of the sums.
Once payment has been made, a document summarizing the order is sent to the Buyer by e-mail to the e-mail address indicated by the Buyer. This document, valid as an acknowledgement of receipt, includes all the elements of the contract between the Parties.
7.5 - REFUSAL TO PROCESS AN ORDER
MY1996 reserves the right to remove a product from the website at any time, to replace or modify its content or information.
In certain circumstances, such as manufacturing or stock problems or in the case of defective series, MY 1996 also reserves the right to refuse an order and may not be held liable to a customer for any harmful consequences.
In the event of technical problems on the website or bugs (incorrect display of prices, quantities available), MY1996 reserves the right to refuse to process an order.
An order may also be refused if it comes from a customer with whom MY1996 has already had a dispute relating to the payment of a previous order or who does not respect the general terms and conditions of sale.
In the event of abnormal or abusive returns, MY1996 may refuse to process a subsequent order.
In the event of cancellation of an order by us, and if payment has already been made, we will reimburse the customer for all sums paid, including delivery costs, as soon as possible, according to the method of payment used when the order was paid for.

8.1 - TERMS AND CONDITIONS FOR EXERCISING THE RIGHT OF WITHDRAWAL
In accordance with article L.221-18 et seq. of the French Consumer Code, the customer as a consumer has a period of fourteen (14) working days from delivery of the order to exercise his right of withdrawal without having to justify his decision and without incurring additional costs.
The withdrawal period runs from physical receipt of the order by the customer or a designated third party, whether the delivery is made to the customer's home, to a relay point or by Click and Collect.
After fourteen (14) days, the sale is considered firm and definitive.
If the order consists of several items delivered separately, the withdrawal period begins upon receipt of the last item.
In order to exercise this right of withdrawal, the customer must inform MY1996 of his decision to withdraw by an unequivocal statement. We provide our customers with a returns form to complete and return to us when returning your order. In order to respect the legal retraction period, you must hand in your parcel at the post office before the fourteen (14) day period expires.
Article L. 221-28 of the French Consumer Code specifies the exceptions to this legal right of withdrawal. The right of retraction can only be invoked if the order concerns goods made at your request, unsealed, worn, washed or damaged.
If the order concerns a gift, we remind our customers that the right of withdrawal is for the exclusive benefit of the customer and may not under any circumstances be exercised by the recipient of the gift.
We inform our customers that, in accordance with article L221-23 of the French Consumer Code, the cost of returning the order will be borne by the customer.
8.2 - EFFECTS OF WITHDRAWAL AND REFUND
Concerning the effects of the right of withdrawal, article L221-24 of the French Consumer Code specifies that "When the right of withdrawal is exercised, the professional reimburses the consumer for all sums paid, including delivery costs, without undue delay and no later than fourteen days from the date on which he is informed of the consumer's decision to withdraw."
We remind our customers that delivery charges will only be refunded if the entire order is returned. Any additional costs resulting from your choice to use a delivery method other than the standard one offered will not be reimbursed under any circumstances.
Example: If you have placed an order with three (3) items and are only returning one (1), then the delivery charges will not be refunded. However, if you return all three (3) items, then MY1996 will refund the shipping charges.
Refunds can be made in one of the following ways:
- via the attribution of a credit note in the form of a gift card which will be generated and affiliated to your account, which you will then be able to use for your next orders on the website.
- via the payment method used when you made your purchase.
Example: If you paid for your purchase via PayPal, the refund will be made via your PayPal account.
If you paid by gift card, the refund will be credited directly to your gift card.
Once we have refunded your order, it will take between 5 and 10 working days for the funds to appear in your bank account or on your gift card.

MY1996 will always suggest to its customers to try to resolve the dispute amicably before taking any legal action.
If the dispute cannot be resolved amicably after a period of two months or if the customer remains unresolved, the customer may have recourse to a mediation service.
The customer may submit the dispute with MY1996 to FEVAD's E-COMMERCE MEDIATION SERVICE (http://www.mediateurfevad.fr). The mediation service will attempt to resolve the dispute between the parties independently and impartially. Both parties are free to accept or refuse the mediation of a dispute, and may also accept or refuse the solution proposed by the mediator.
In the event of cross-border disputes, the customer may contact the dispute resolution platform set up by the European Commission at the following address: http://ec.europa.eu/consumers/odr/.
The customer also has the option of bringing the dispute before a competent court in accordance with the French Consumer Code and the French Code of Civil Procedure.
The competent court may be that of MY1996's registered office, that of the customer's place of residence or that of the place of delivery of the order.
